01The agreement
Your photos stay yours, and your edits stay on your phone. In return we ask that you use PhotoMaker lawfully, on content you have the right to use, and accept that a free app comes with no warranty.
By downloading, installing or using PhotoMaker (the "App") you agree to be bound by these Terms & Conditions and by our Privacy Policy, which forms part of this agreement. If you do not agree to all of them, do not use the App.
02Your licence to use the app
Retroline grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for personal or commercial photo editing. This licence does not transfer ownership of the App to you.
Your use of the App is also subject to the Google Play Terms of Service. Where those terms and these conflict for matters of distribution, the Google Play terms apply.
03Acceptable use
You agree that you will not:
- Use the App on images you do not own or otherwise have the right to edit, or in a way that infringes anyone's copyright, trademark, privacy or publicity rights.
- Use the App to create or distribute content that is unlawful, defamatory, harassing, sexually explicit involving minors, or intended to deceive — for example fabricated images presented as genuine photographs of real people or events.
- Copy, sell, rent, sublicense or redistribute the App, or any of its bundled assets, filters, models or presets, as a standalone product.
- Reverse engineer, decompile, disassemble or attempt to derive the source code of the App, except to the extent that applicable law expressly permits it.
- Interfere with the ads shown in the App, tamper with its network requests, or circumvent any technical limitation in it.
- Use the App in any way that breaks the law where you are.
04Your photos and your rights
You keep every right you already have in your photos. The App edits them on your device; we claim no ownership, no licence and no right to use anything you open, create or export. We do not receive your images, so we could not use them even if we wanted to.
That also means you are solely responsible for what you edit and where you publish it, and for keeping your own backups. Exports are written to Pictures/PhotoMaker on your device — if you delete them or lose the device, we have no copy to restore.
05Ads
- The App is free and shows ads served through Google AdMob. Ads help pay for its development.
- We do not use the contents of your photos or your editing activity to target ads.
- The ad SDK may use your Android advertising ID and device information; see the Advertising section of our Privacy Policy for what is collected and how to opt out of personalisation.
- We do not endorse advertisers or the products in their ads, and we are not responsible for anything you buy from them.
06Third-party services
The App relies on services provided by Google — Google Play for distribution, Google Mobile Ads for advertising, Firebase Crashlytics for crash reporting, and Google Play services / ML Kit for the on-device subject-segmentation model. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their availability or behaviour.
07Our intellectual property
The App, its name, icon, interface, code, and the filters, styles, templates, stickers, fonts and sample images bundled with it are owned by Retroline or its licensors and are protected by copyright and other laws. You may use the bundled assets in images you create with the App; you may not extract, repackage or redistribute them on their own.
Google Play and the Google Play logo are trademarks of Google LLC. Android is a trademark of Google LLC.
08Availability and updates
- We may add, change or remove features, and we may release updates that change how the App behaves.
- Some features depend on your device and on Android version — the App requires Android 7.0 or newer, and performance on very large images depends on available memory.
- We may stop distributing or supporting the App at any time, with or without notice. Copies already installed keep working until they no longer run on your device.
09Disclaimer of warranties
The App is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.
- We do not warrant that the App will be error-free, uninterrupted, or free of defects.
- We do not warrant that an edit, export or AI result will match your expectations.
- We are not responsible for lost, corrupted or overwritten images. Keep your own backups of anything that matters.
10Limitation of liability
To the maximum extent permitted by law, Retroline will not be liable for any indirect, incidental, consequential, special or punitive damages arising out of your use of, or inability to use, the App — including lost profits, lost data, lost images, business interruption or personal injury — even if we were advised that such damages were possible.
Because the App is provided free of charge, our total aggregate liability to you for all claims relating to the App will not exceed the amount you paid for it, or USD 10, whichever is greater. Nothing in these terms excludes liability that cannot lawfully be excluded, and some jurisdictions do not allow the exclusions above, in which case they apply to you only as far as the law permits.
11Indemnity
You agree to indemnify and hold Retroline harmless from any claim, demand, loss or expense — including reasonable legal fees — arising from images you create or publish with the App, or from your breach of these terms or of anyone else's rights.
12Termination
- You may end this agreement at any time by uninstalling the App and ceasing to use it.
- We may suspend or terminate your licence to use the App if you breach these terms, with or without notice.
- Sections on intellectual property, disclaimers, liability and indemnity survive termination.
13Changes to these terms
We may revise these terms as the App changes. The current version is always posted on this page with its effective date, and material changes will also be noted in the Google Play release notes. Continuing to use the App after a change means you accept the revised terms; if you do not, stop using the App and uninstall it.
14Governing law and severability
These terms are governed by the laws of the jurisdiction in which Retroline is established, without regard to conflict-of-law rules, and without depriving you of the mandatory consumer protections of the country where you live. If any provision is found unenforceable, the rest stays in force.
